Constitution is a prime law of the state where all the political, judicial, executive, federal authority, rights, rules and regulations as well all the necessary laws needed to run the everyday function of country is included in the constitutions. So, it is very important for the country and its people. It is a backbone for a democratic and lawful state.
Now, Nepal is in the process of drafting new constitution through the constituent assembly that was elected by people in 2008 April. It’s really a good idea and democratic process. But since 1 year after CA election, there is no one line of constitution is written yet. It’s sad to say that. Constituent Assembly even doesn’t present the structure of constitution yet and there are so much speculation, argument, differences and debate for the drafting new constitutions. Nepal is already declared Republic and there is no more king rule and kingship. Most of the political parties have decided to go for federalism. Still, there are so many differences about how the federal state is divided. Some factions are saying state should be identified and designed based on the ethnic and language of the particular region and some factions are saying to design based on geography and economic potentiality etc. There are so many option comes out regarding government system like presidential system or prime ministerial system to govern the nation.
Nepal is a largely mix society. I don’t see there is any region or place in Nepal where only a single ethnic group or language is dominant or in majority. Actually, Nepal is a country of minority. There are so many ethnics, languages and religious people but no single ethnic group is in majority. So, it is not a good idea to divide the country only based on ethnic people and language. It may create problem and division among the people and might bring conflicts. Everyone should keep in mind that this is 21st century and nobody can rule and to be ruled in the country and society. I don’t understand why our leaders and their followers are becoming foolish and they are thinking such a way which is not practical and not appropriate for nation as well. There are so many languages like around 100 languages. But Nepali language is very common, it is the fact. Everybody speaks Nepali. If everybody speaks Nepali in Nepal then it is very good for nation, what’s wrong. It is true that we should preserve other language, culture because Nepal is a diverse country by its people, culture and language. Diversity is our strength and beautiful ornaments of the country. Why this facts don’t understand by people. Nepal is very small country by area and even by population too. This is really a beautiful country with varieties of landscape, mountains, and climate and its scenic beauty. We can develop Nepal as a heaven. For this we people should not only divided and stop just because of ethnic, language, caste and religion. We should be open mind and help each other to develop our country. Our main problem is poverty, unemployment, lack of education and poor infrastructure; we should unite and fight against all the things that is quite important. Only drafting constitution, and dividing country by caste, ethnic and languages cannot solve the problem, it’s just a political system and division of country by caste and ethnic bases can be harmful and it may brings new kind of conflicts in the society. I don’t have any objection to go federalism but I assume that Nepal can be developed without federalism too. Now, the debate of federalism is so high, there is so many differences among people and Nepal can be deadlock due to the only debate and fight for these things. It would be very bad this time if country cannot go ahead.
In my view, there should a both president and prime minister to lead the government with the concept of power separation. President should be directly elected by people and prime minister should be elected by parliament. President should have rights to see the foreign policy, head of state, army supreme commander, major economic policy, passing bills or rejecting, decide major issue like treaty etc. and prime minister should have rights to lead the government’s administrative job, formulate plan and implement, run development project etc. Such power separation can help t lead the country with good leadership. Both Prime Minister and President cannot dissolve the parliament; this law must be implemented strictly. Only Supreme Court can decide regarding this issue.
It is wise not to divide country on the basis of caste and ethnic group but rather it can be divided based on the geography and political basis. There should be local government which is will plan and implement all the development project coordinating with central government. Each federal state should be lead by directly elected governor of the state and his/her tenure should be 3 or 4 years and governor can be sacked by parliament majority if he/she did some wrong doing.
The entire parliament member, Ministers, President and Prime Minister should have certain level of educational or academic background. At least 10+2 pass people can be MP and ministers, but to be president and prime minister, they must have at least bachelor level education. This must be clearly mentioned in the constitutions.
Major treaty with foreign country should be passing through referendum, so that directly people can participate to decide such big issue.
Nepali should be our official language, but we should recognize all the language like Tharu, Maitihili, Rai, Limbu, Bhojpuri, Tamang, Magar etc. There should be right to study in mother tongue and it should be implemented strictly. English should be a prime medium of language in school and university because this is 21st century global world, and English is the only language which is spoken all over the world.
Education should be fundamental rights of all people living in the country; it must be guarantee in new constitutions.
These are the things which I have seen flatly and I guess this issue should be resolve first in the constitutions. I don’t believe only in good constitution, constitution was not a problem of Nepal , our main problem is failure leadership and their ill motive to stay in government and always stay with the periphery of their cronies , cadres and blind followers.
